These Terms of Service set out the rules that apply when you visit this website, start a weekly batch subscription or buy a gift box roast from Homesik Coffee LLC. They are the commercial counterpart to our Privacy Policy and they describe what you can expect from us and what we expect from you. Please read them carefully before you place an order. If you do not agree with any part of these terms, please do not use the website or buy a subscription. You can always write to us at hello@homesikcoffee.buzz or call +19897483675 if something in these terms is unclear. The organization that sells coffee under these terms is Homesik Coffee LLC, with its place of business at 3586 S Davi Ct, West Valley City - 84119-3499, United States (US).
1. Acceptance of These Terms
By accessing this website, by subscribing to a weekly batch, by buying a gift box or by sending us a message through the contact form, you agree to be bound by these Terms of Service and by our Privacy Policy. If you are agreeing on behalf of a company or another person, you confirm that you have authority to bind that entity to these terms. If you do not have that authority, please do not place an order on behalf of that entity.
These terms replace any earlier understanding between you and Homesik Coffee LLC about the subject matter covered here, whether written or spoken, except where a separate signed agreement says otherwise. A statement made casually during a telephone conversation does not override these terms unless we confirm it in writing. We want to be friendly, but a small business also needs a clear written record of what it promised.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be adjusted to the minimum extent necessary to make it enforceable while preserving its original intent. This approach keeps the rest of the agreement intact for both parties.
2. Who We Are
Homesik Coffee LLC is a limited liability company registered in the United States and operating a home roast subscription roastery from West Valley City, Utah. Our full postal address is 3586 S Davi Ct, West Valley City - 84119-3499, United States (US). Our general contact email is hello@homesikcoffee.buzz and our telephone number is +19897483675. These are the details you should use for any formal notice under these terms.
The roastery roasts, cups and writes in one location. That means the person who answers your question is likely the person who roasted your coffee. We mention this because it shapes how we work: our capacity is deliberately limited, our batches are small, and our schedule is built around quality rather than volume. When we accept a subscription, we commit roasting time to it, and that commitment is the reason we ask you to give us reasonable notice before cancelling.
We may refer to ourselves in these terms as we, us or our. We may refer to the person using the website or buying coffee as you or your. The headings in these terms are for convenience only and do not affect the meaning of any provision.
3. Eligibility to Order
You must be at least eighteen years old to place an order, or the age of majority in your jurisdiction if that age is higher. By placing an order, you confirm that you meet this requirement and that the information you provide is accurate and complete. We may ask for confirmation of age where an order appears unusual, but we do not routinely collect identity documents.
You must provide a delivery address where a parcel can be received safely. We are not responsible for a parcel that is left at an address you supplied if that address is incomplete or if nobody is able to receive it. If a carrier returns a parcel because the address was wrong, we will contact you to arrange a reshipment and we may ask you to cover the additional shipping cost.
We reserve the right to decline an order in limited circumstances, for example where we suspect fraud, where a previous payment failed and remains unresolved, or where the volume requested exceeds our roasting capacity. If we decline an order, we will tell you why and we will refund any amount already charged for that order.
4. Weekly Batch Subscriptions
A weekly batch subscription is a standing order. When you start one, you choose a cadence, a roast profile and a delivery address, and we roast a small batch on your behalf on a regular schedule. The schedule is set so that every bag rests for a consistent period before it ships, which is why we cannot move a roast date on short notice without affecting quality.
Each subscription runs until you pause it or cancel it. We will send a confirmation when the subscription starts and a reminder before a price or schedule change takes effect. You are responsible for keeping your delivery address and payment details current. If a charge fails, we will notify you and pause the next roast until the payment is resolved, so that we do not send coffee that has not been paid for.
We may adjust the roast date by up to two business days because of equipment maintenance, a green lot delay or a public holiday. If the change is longer than two business days, we will tell you in advance and offer either a revised date or a pause without penalty. We will not substitute a different coffee without telling you, and where a substitution is unavoidable we will describe it in the cupping note letter.
5. Pricing and Recurring Charges
Prices are shown on the website and in the subscription confirmation. All amounts are stated in United States dollars unless another currency is clearly indicated at checkout. Prices include the cost of the coffee, the packaging and the written materials, but they do not include any local tax, customs duty or import fee that may apply in your jurisdiction. You are responsible for those charges where they apply.
By starting a subscription, you authorize us and our payment processor to charge the agreed amount on a recurring basis until you pause or cancel. The first charge is taken at the time of order and subsequent charges follow the cadence you selected. We will give you at least fourteen days notice before an increase in the recurring price, and you may cancel before the increase takes effect without penalty.
If a charge is reversed, disputed or returned, we may suspend the subscription until the matter is resolved. We will not add a separate penalty fee for a single failed charge, but we may ask you to cover a bank fee that we are actually charged as a result. Any such fee will be shown to you before it is applied, and it will never exceed the amount the bank charged us.
6. Shipping, Delivery and Risk
We ship with a carrier that provides tracking. A tracking number is sent when the parcel leaves the roastery. Delivery estimates depend on the destination and are provided by the carrier rather than by us, so we cannot guarantee an exact delivery time. We do guarantee that the parcel leaves our building within the shipping window stated on the subscription confirmation.
Risk of loss passes to you when the carrier records delivery at the address you supplied. If the tracking record shows a delivery but the parcel is missing, please contact us anyway. We will open a carrier investigation with you, and if the carrier cannot resolve the case, we will work out a fair solution, which may include a replacement at a reduced or waived shipping cost.
We are not responsible for a delay caused by a customs inspection, a severe weather event, a carrier strike or another event outside our reasonable control. In those cases we will keep you informed and we will reship a parcel that is confirmed lost. We will not leave you without coffee and without an explanation. That is a simple promise, and we intend to keep it.
7. Freshness and Coffee Quality
Coffee is an agricultural product and each batch is slightly different. We roast to a profile rather than to an exact colour, because the green lot, the moisture and the ambient conditions all influence the result. A batch that tastes bright and citric one week may taste rounder the next. That variation is normal and it is one of the reasons we write a cupping note letter with every shipment.
We recommend drinking a bag within four to six weeks of the roast date and we print that date on every label. A bag stored in a sealed container away from heat and light will hold its character well for that period. A bag left open on a counter will fade faster, and no roastery can prevent that. We include a short storage note on the brew guide sheet so that the advice travels with the coffee.
If a batch does not taste as described and you believe we made a mistake, tell us within fourteen days of delivery. We will ask a few questions about your brew method and water, because many flavour problems come from the brew rather than the roast. If the fault is ours, we will replace the bag or refund it. We do not require you to return the coffee, because a returned bag cannot be resold and the postage would cost more than the coffee.
8. Gift Box Roasts
A gift box roast is assembled for a date you name. We roast the coffee close to that date so the recipient receives a fresh bag, and we include a cupping note letter and a brew guide sheet in the box. You may include a short message, which we will print on a plain card. Please keep the message brief and avoid content that is unlawful or offensive, because we reserve the right to decline a message that we cannot in good conscience print.
Gift boxes are treated as a one time purchase rather than a subscription. We do not enroll the recipient in a recurring plan and we do not send marketing messages to the recipient. If the recipient wants to continue after the gift, they can start their own subscription and we will welcome them as a new subscriber.
If a gift box arrives damaged, contact us within fourteen days of the delivery date and we will arrange a replacement. If the gift was never delivered because of an address problem, we will contact you to confirm the correct address. We cannot reroute a gift after it has shipped without an additional carrier fee, which we will quote before we act.
9. Cupping Letters and Brew Guides
The cupping note letter and the brew guide sheet are part of the product, not a marketing extra. The letter records the cupping session behind your batch, including the score sheet and any profile change made as a result. The brew guide is a single page that gives a dose, a grind window and two brew methods tested in the roastery kitchen. Both documents are written for the specific lot you received.
We write these materials in good faith and we test the recipes on our own equipment, which may differ from yours. A recipe is a starting point rather than a guarantee, and a small adjustment to grind or water temperature is usually needed at home. If a recipe does not work on your setup, tell us during a question hour and we will suggest a change. That feedback also helps us write clearer guides in future.
You may share a letter or a guide with a friend who is curious about the coffee. You may not republish the materials commercially, sell them, or present them as your own work. The writing is a substantial part of what we do, and we ask that you credit Homesik Coffee LLC when you quote from it in a public post.
10. Home Barista Q and A Hours
Home barista question hours are open sessions where subscribers bring a grinder, a kettle or a stubborn recipe and we work through the problem together. Sessions are announced by email and are held in small groups so that everyone gets time. Places are limited because the roastery is small, and we ask that you tell us in advance if you cannot attend so that the place can be offered to someone else.
Advice given during a question hour is practical guidance based on our experience. It is not a professional engineering or safety assessment. If you are working with modified equipment, high pressure or electrical components, you are responsible for making sure that your setup is safe and compliant with local rules. We will not advise you to bypass a safety device, and we may decline to comment on a modification that we consider unsafe.
We may record general notes from a session so that the advice can be turned into a short written summary for other subscribers. We will not publish your name or your words without asking first. If you prefer not to be recorded in any form, tell us at the start of the session and we will leave you out of the notes.
11. Pausing, Cancelling and Refunds
You may pause a subscription at any time before the roast date for the next batch. A pause stops future roasts and future charges until you resume. You may cancel at any time, and cancellation stops future charges from the next billing cycle. A batch that has already been roasted and shipped is not refundable merely because you cancelled afterward, because the coffee has already been made and sent.
If you cancel within twenty four hours of a new order and before the roast has started, we will refund the full amount. If the roast has started but the parcel has not shipped, we will refund the amount minus the cost of the green coffee that was committed to your batch, and we will explain that amount in writing. After a parcel has shipped, the refund rules for damaged or incorrect orders apply instead.
Refunds are issued to the original payment method. A refund usually appears within five to ten business days, depending on the bank. We will send you a confirmation when the refund is issued so that you have a record. If a refund does not appear after ten business days, contact us and we will trace it with the processor.
12. Damaged, Missing or Incorrect Orders
If a parcel arrives damaged, please photograph the packaging and the contents before you discard anything, and contact us within fourteen days of delivery. We will review the photographs and arrange a replacement or a refund. We do not require the damaged coffee to be returned, because a returned bag cannot be resold and the postage is rarely worth the cost.
If a parcel is missing, check the tracking record first and ask neighbours or the building office whether the parcel was left nearby. If the parcel still cannot be found, contact us and we will open a carrier investigation. Most missing parcels are found within a few days. If the carrier confirms a loss, we will reship or refund, at your choice.
If you receive the wrong coffee, tell us and keep the bag sealed. We will send the correct lot and we will tell you what to do with the incorrect bag. In many cases we will ask you to keep it as a gift, because a return costs more than the coffee. We would rather you try an unexpected lot than pay for postage on a mistake that was ours.
13. Acceptable Use of This Website
You may use this website for lawful purposes and in a way that does not interfere with another person. You may not attempt to gain unauthorized access to any part of the site, to a subscriber account or to a server that supports the site. You may not use automated tools to scrape the site at a rate that degrades service for others, and you may not submit content that is unlawful, defamatory, harassing or designed to deceive.
You may not use the contact form to send unsolicited commercial messages, to distribute malware or to impersonate another person. We may block a sender or an address that abuses the form, and we may report a serious abuse to the relevant authority. We would rather have a quiet inbox than a busy one filled with noise.
We may suspend access to the website for maintenance or security reasons. We will try to keep any suspension short, and we will not use a suspension to avoid an obligation to a subscriber. A live subscription continues during a website suspension, and we will communicate by email if the site is unavailable for more than a day.
14. Intellectual Property
The website, the cupping note letters, the brew guide sheets, the flavour wheel graphic, the roast log layout and the written text on these pages are owned by Homesik Coffee LLC or are used with permission. They are protected by copyright and, where applicable, by trademark and other laws. You may view the site and print a single copy of a page for personal use, but you may not reproduce, distribute, modify or create a derivative work from our materials for a commercial purpose without written permission.
The names Homesik Coffee and Homesik Coffee LLC, together with the visual identity of the roastery, are our marks. You may refer to us by name in a review, a news article or a social post, and you may link to our pages. You may not use our name or logo in a way that suggests an endorsement, a partnership or a sponsorship that does not exist.
If you believe that material on this site infringes a copyright you own, please write to hello@homesikcoffee.buzz with a description of the work, the location of the material on our site and your contact details. We will review the notice promptly and remove material that is shown to infringe. We take intellectual property seriously because our own work depends on the same protection.
15. Content You Send Us
When you send us a message, a photograph or a brew note, you keep ownership of that content. You grant us a limited permission to use it for the purpose you sent it for, such as answering your question or improving a brew guide. If we would like to publish your content on the website or in a letter, we will ask for your permission first and we will credit you in the way you prefer.
You confirm that you have the right to send the content and that it does not infringe the rights of another person. If a photograph includes another person, you confirm that you have their permission to share it with us. We may remove content that we cannot verify or that raises a privacy concern, and we will tell you if we do.
We keep messages for the period described in our Privacy Policy. If you ask us to delete a message, we will delete it from active systems, subject to any record we must keep by law. A published quote will be removed on request, and we will not argue about it.
16. Third Party Services
We use third party services for payment processing, email delivery and parcel shipping. Those services have their own terms and privacy policies, and your use of them is governed by those documents as well as by these terms. We choose our providers carefully and we hold them to written expectations, but we do not control their internal operations.
This website may link to a third party page. A link does not mean that we endorse everything on the destination, and we are not responsible for the content, security or availability of a site we do not operate. If a link leads to something harmful, please tell us so that we can remove it.
If a third party service experiences an outage, we may not be able to process a payment, send a letter or ship a parcel on the usual schedule. We will tell you as soon as we know and we will make up the delay where we can. We will not charge you for a service we could not deliver because of an outage that we could reasonably foresee and avoid.
17. Disclaimers
This website and its content are provided on an as available basis. We work to keep the site accurate and available, but we do not promise that it will be free of errors or interruptions. Product descriptions, photographs and flavour notes are written in good faith and are intended as a guide rather than a guarantee of a specific sensory experience.
Coffee is a food product. If you have a medical condition, an allergy or a sensitivity, please consult a qualified professional before making a dietary decision. Our coffee is roasted in a facility that handles coffee only, but green coffee and roasted coffee can carry trace elements from the farm and the transport chain. We cannot guarantee the absence of every trace substance.
Nothing on this website is medical, legal, financial or engineering advice. Advice given during a question hour is practical guidance based on our experience and is provided without a warranty of any kind. You are responsible for how you apply that guidance to your own equipment and circumstances.
18. Limitation of Liability
To the fullest extent permitted by law, Homesik Coffee LLC will not be liable for an indirect, incidental, special, consequential or punitive loss arising from your use of this website or from a subscription, including a loss of profit, a loss of data or a loss of opportunity. This limitation applies whether the claim is based on contract, tort, statute or another theory, and whether or not we were advised of the possibility of such a loss.
Our total liability for a claim connected to an order will not exceed the amount you paid for that order. Where the law does not allow a limitation of liability for a particular type of loss, this limitation will not apply to that loss, but it will continue to apply to every other loss.
Nothing in these terms excludes a liability that cannot be excluded by law, including a liability for fraud or for a deliberate wrongdoing. We include this limitation because a small roastery cannot carry the risk of a large indirect loss, and a fair limitation keeps the price of a bag of coffee reasonable for everyone.
19. Indemnity
You agree to indemnify and hold harmless Homesik Coffee LLC, its members, employees and agents from a claim, loss or expense that arises from your breach of these terms, your misuse of the website or your violation of the rights of another person. This obligation includes reasonable legal fees where a claim proceeds to a formal dispute.
We will tell you promptly about a claim that may trigger this obligation and we will give you a reasonable opportunity to participate in the response. We will not settle a claim in a way that admits fault on your part without your consent, unless the law requires a settlement to proceed.
This obligation does not apply to a claim that is caused by our own negligence or by our breach of these terms. It is meant to cover a situation where your conduct creates a problem for us, not a situation where we create a problem for ourselves.
20. Privacy and Information
Our Privacy Policy explains how we collect and use information. It is incorporated into these terms by reference, which means that a promise about information in the Privacy Policy is also a promise under these terms. If there is a conflict between the two documents about information handling, the Privacy Policy will control for that specific point.
You are responsible for keeping your contact details accurate so that we can send the letters and notices that a subscription requires. If you change an email address or a delivery address, update it before the next roast date. A message sent to an address you supplied is treated as delivered for the purpose of these terms.
We will notify you about a security incident that affects your information as described in the Privacy Policy. We will not use a privacy right as an excuse to avoid a commercial obligation, and we will not use a commercial obligation as an excuse to ignore a privacy right.
21. Governing Law and Disputes
These terms are governed by the laws of the State of Utah and the applicable laws of the United States, without regard to a conflict of laws rule. A dispute that cannot be resolved informally will be brought in a court of competent jurisdiction located in Utah, and both parties consent to the jurisdiction of that court.
Before filing a formal claim, please write to hello@homesikcoffee.buzz with a description of the problem and the outcome you are seeking. We will respond within a reasonable time and we will try to resolve the matter directly. Most disagreements about a bag of coffee can be settled with a replacement or a refund, and a conversation is faster and cheaper than a filing.
If a claim is small, either party may use a small claims process where the law allows it. Nothing in this section prevents a party from seeking urgent relief where a delay would cause harm. We would rather solve a problem at the roastery than in a courtroom, and we will make a genuine effort to do so.
22. Changes to These Terms
We may update these terms when our practices change or when the law requires a different disclosure. When we make a material change, we will update the effective date at the top of this page and, where the change affects an active subscriber, we will send a short email that summarizes what changed and when it takes effect.
A change will not apply retroactively to an order that was placed before the change unless the law requires it. If you do not agree with an update, you may cancel a subscription before the update takes effect and we will honor the cancellation without penalty.
We keep a dated copy of each version of these terms so that we can answer a question about what the agreement said at a particular time. If you need a copy of an earlier version, write to us and we will provide the version that was in force on the date you specify.
23. General Provisions
These terms, together with the Privacy Policy, form the entire agreement between you and Homesik Coffee LLC about the subject matter covered here. A failure to enforce a provision on one occasion does not waive the right to enforce it later. A waiver must be in writing and signed by an authorized representative to be effective.
You may not assign your rights under these terms without our written consent. We may assign our rights to a successor in connection with a sale or reorganization of the business, provided that the successor agrees to honor these terms for existing subscribers.
If a provision is found to be invalid, the remaining provisions will continue in effect. The headings in these terms are for convenience only. A notice under these terms must be sent in writing to the address or email listed in the next section. A notice sent by email is treated as received on the next business day after it is sent, provided that the sender does not receive an automated failure message.
24. How to Reach Us
If you have a question about these terms, a concern about an order or a notice to deliver, please contact us using any of the channels below. We prefer email for a detailed matter because it creates a written record, but a telephone call is fine for a quick question and we are happy to speak with you directly.
